Background of the case


Zinnia M. Khajotia file Fir against Joseph Paul De Souza. She accused him of sending defamatory and Objectionable words send through emails, which were also circulated among other residents of their housing society. These emails allegedly defamed her and outraged her modesty, leading to the registration of an FIR against De Souza under various sections of (IPC) and the Information Technology Act, 2000.


Judgment ruled by Bombay High Court

Objectionable words written in an e mail and Social media can be penalized for insulting a women modesty , says the Bombay High court.

And Person shall punish under :-

Section 79 of BNS:-

Whoever, intending to insult the modesty of any woman, utters any words, makes

any sound or gesture, or exhibits any object in any form, intending that such word or sound

shall be heard, or that such gesture or object shall be seen, by such woman, or intrudes upon the privacy of such woman,

shall be punished with simple imprisonment for a term which may extend to three years, and also with fine.
